Acceptable Use Policy

Version: 2026-05-31 Applies to: each individual user and the Organization


This Acceptable Use Policy (“AUP”) governs use of the SimCheck Services operated by Diospyros Holdings LLC. It is incorporated into, and a material part of, the Terms of Service and the EULA. Capitalized terms have the meanings given there. We may update this AUP as described in Section 10; violations may result in content/code removal, suspension, or termination.

1. Your Responsibility

You are responsible for all activity under your organization and for your Authorized Users’ compliance with this AUP. You will ensure that anyone you permit to use the Services agrees to and follows it, and you will not authorize or assist others to do anything this AUP prohibits.

2. Lawful Network Testing Only

You will use the Services only for lawful testing that you are authorized to perform, and you will:

  • comply with all applicable laws, regulations, and licensing requirements (including telecommunications and radio/spectrum rules) in every jurisdiction where tests physically run;
  • not interfere with, disrupt, degrade, overload, jam, or attempt to gain unauthorized access to any mobile network, carrier system, base station, or third-party infrastructure;
  • not engage in signaling abuse, artificial traffic inflation, SIM-box/bypass fraud, or other activity that violates a carrier’s terms or any law;
  • not place fraudulent, deceptive, harassing, or unlawful calls or messages, and not use the Services to send spam or unsolicited communications.

3. SIMs, eSIMs, and Network Authorization

  • You represent and warrant that you are authorized to test the SIM and eSIM profiles you submit and the networks you target.
  • You will not upload eSIM activation credentials, ICCIDs, download codes, or other subscriber credentials that you do not have the right to use, and you will not use the Services to traffic in or misuse such credentials.
  • You are responsible for any charges, roaming fees, data usage, or carrier consequences arising from tests you run.

4. Customer-Authored Code (localScript)

Where you upload and run your own scripts on your private Edge Devices:

  • the code and its effects are your responsibility — you warrant it contains no malware, backdoors, or unlawful content and does not attempt to escape its sandbox, exfiltrate data, escalate privileges, or compromise the device, platform, or other tenants;
  • you will not use it to consume resources abusively or to circumvent platform limits, quotas, the AT safety policy, or tenancy controls;
  • customer-authored code may run only on Edge Devices owned by your organization, never on Shared Equipment;
  • you will comply with all third-party license terms applicable to any code or dependencies you include.

5. Shared Equipment Fair Use

When you use Shared Equipment (the “platform commons”):

  • use it fairly and do not monopolize, damage, degrade, or attempt to take exclusive or persistent control of shared devices or modems;
  • do not attempt to access, observe, or interfere with other tenants’ data, allocations, locks, sessions, or results;
  • understand that Shared Equipment is provided best-effort and may be unavailable, rescheduled, or reconfigured at any time.

6. Security and Platform Integrity

You will not:

  • probe, scan, or test the vulnerability of the Services, or breach or circumvent authentication, authorization, RBAC, tenancy isolation, or security measures, without our prior written authorization;
  • access accounts, data, or systems you are not authorized to access, or use another’s credentials;
  • introduce malware, conduct denial-of-service attacks, or disrupt the Services for others;
  • use automated means to access the Services in a manner that exceeds reasonable use or evades rate limits, except through documented APIs within their limits.

7. Data, Privacy, and Content Standards

  • You will only submit Customer Data you are authorized to submit, and you will provide all notices and obtain all consents required for SimCheck to process it.
  • You will not upload unlawful content, infringe third-party intellectual-property or privacy rights, or use the Services to process data in violation of applicable privacy law.

8. Export, Sanctions, and Anti-Fraud

You will not use the Services in violation of export-control or sanctions laws, on behalf of sanctioned parties, or for fraudulent, deceptive, or unlawful purposes.

9. Monitoring, Reporting, and Enforcement

We do not routinely monitor content but may investigate suspected violations and review activity, logs, and audit records as needed to operate and protect the Services. We may remove or disable offending content or code, throttle, suspend, or terminate access, and cooperate with law enforcement where required. We may act immediately, with notice where practicable, when a violation threatens the platform, other customers, or mobile networks. Suspected violations may be reported to legal@simcheck.ai.

10. Changes

We may update this AUP from time to time. When we make material changes, we will post the updated AUP with a new version and provide notice (for example, by email or within the Services). Your continued use of the Services after the update takes effect constitutes acceptance.
